Risk Warning

Effective date: 3 December 2023
Last updated: 3 December 2023

This Risk Warning relates to the osgt.uk website and to the deposit management services provided by Open Smart Gambling Technology Ltd, a company registered in England and Wales under number 15326596, with its registered office at 122 Leadenhall Street, London, EC3V 4AB, United Kingdom (“OSGT”, “we”, “us”).

Please read this document in full before you transfer any funds into our management. If anything is unclear, do not transfer funds and contact us at info@osgt.uk or seek independent advice.

1. The essentials

Transferring funds into the management of OSGT involves a high level of risk. You may lose part of the funds you transfer, or all of them. Profit is never guaranteed, under any circumstances.

2. Past results are not a guide to future results

Any figures relating to past periods — our own, the results of individual clients, the results of individual analysts, and any figures published on this website or in the press — describe the past and are not a promise of any future result. They create no obligations of OSGT and must not be used as a basis for calculating expected income.

All calculations, examples and calculators on this website are illustrative. They show how the profit distribution arithmetic works, not how much you will receive.

3. Losses are possible in individual periods

The result of the management varies from day to day and from month to month. In individual months the result may be negative. Several loss-making periods in a row are possible and do not constitute a breach of the agreement or a malfunction.

4. The activity is inherently risky

Funds are used to carry out transactions (bets) with gambling companies on the outcomes of sporting and other events. The outcome of any individual event is not known in advance. No analysis, statistics or experience removes that risk; they only affect the probability of the result.

5. Your funds are outside our control while they are placed

Once funds have been placed with a gambling company, they are held by that company and not by us. Under its own rules, a gambling company may block, withhold, cancel or confiscate funds, or restrict or close an account. We make reasonable efforts to recover such funds, but we do not guarantee any result.

6. The management fee is charged irrespective of the result

The management fee is 5% per annum of the amount held in management and is debited in addition to the amount transferred. It is charged in profitable and in loss-making periods alike and is non-refundable, including where funds are withdrawn before the end of the year paid for and on termination of the agreement.

7. The profit share is withheld at the end of each profitable day

The OSGT profit share is withheld at the end of each profitable trading day. Loss-making days do not reduce or offset it. This means that over a period whose aggregate result was nil or negative, you may still have paid a profit share in respect of the individual profitable days within that period.

8. The loss coverage fund contribution is not insurance

1% of profit is withheld as a contribution to the loss coverage fund. This is not insurance and not a guarantee that your funds will be returned. The contribution gives you no right of claim against the fund. The way the fund is formed and applied is determined by OSGT.

9. Risks of settlement in USDT

All settlements are made in USDT. You accept the risk of a change in the value of USDT against the US dollar and other currencies, as well as the risks associated with the use of digital assets: blocked transfers, technical failures of transfer networks, network fees and the actions of the issuer of USDT. An error in the wallet details on withdrawal may result in the irreversible loss of funds.

10. This is not a bank deposit and FSCS deposit protection does not apply

Funds transferred into the management of OSGT are not a bank deposit with OSGT. OSGT does not provide the client with a bank deposit account, and the deposit protection provided by the Financial Services Compensation Scheme (FSCS) for eligible deposits with authorised banks, building societies and credit unions does not apply to funds transferred to OSGT under this service. Any separate protection that may apply to a regulated third-party provider involved in a particular transaction depends on that provider's status and terms and is not a guarantee given by OSGT.

11. We do not provide investment, tax or legal advice

The materials on this website and communications from our staff are provided for information only and do not constitute a personal recommendation, investment advice, or tax or legal advice. The decision to transfer funds is yours alone.

No oral statements, advertising materials or publications which are not included in the text of the agreement form part of its terms or create any obligations of OSGT.

12. Transfer only what you can afford to lose

Do not transfer into management any borrowed or credit funds, or any funds whose loss would place you in hardship.

13. Age and country restrictions

The services are available to persons aged 18 or over, or such higher age as applies to participation in gambling in your place of permanent residence. Our services are not available to US residents. You are responsible for satisfying yourself that transferring funds and receiving payments is permitted under the law of your country of citizenship and residence, and you bear the risks associated with this. You are responsible for your own tax obligations in your place of tax residence.

14. Responsible gambling

If your involvement in gambling-related activity stops being manageable, free and confidential support is available. In the United Kingdom, you can contact GamCare / the National Gambling Helpline on 0808 8020 133 or via gamcare.org.uk, and you can also find information and support services at gambleaware.org.

15. What is legally binding

This Risk Warning explains the risks in plain language. Your rights and obligations are set out in the agreement, in particular section 15 “Risks and Limitation of Liability” and section 24 “Risk Disclosure Statement”. In the event of any inconsistency between this page and the agreement, the agreement prevails.

16. Changes

We may update this Risk Warning. The current version is always published on this page with the date of the update.
